User Agreement (Terms of Service)

1. Eligibility and Account Security

• Age Requirement: You must be at least 18 years old to use the Services independently.

• Minor Usage: Users between 13 and 18 years of age may only use the Services with the verifiable management and consent of a parent or legal guardian.

• Prohibited Users: Use by anyone under the age of 13 is strictly prohibited.

• Account Accuracy: You agree to provide accurate registration information, including your name and email address.

• Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. The Cosnap Service (Facial Recognition)

Cosnap provides an AI-driven photo-matching service designed to deliver event photos to your account.

• Functionality: When you enable facial recognition, the app analyzes photos uploaded by event photographers to identify you and deliver those photos to your gallery.

• Biometric Consent: By opting into this feature, you provide your express written consent for Cosnap LLC to process your biometric identifiers, specifically facial embeddings.

• Optional Use: Facial recognition is entirely optional. You may disable this feature at any time in your account settings, though doing so will prevent the core photo-matching functionality from working.

3. User Content and Licensing

• Ownership: You retain ownership of all content you upload to your profile, such as your reference selfie ("User Content").

• License to Cosnap: You grant Cosnap LLC a worldwide, non-exclusive, royalty-free license to store, process, and use your photos solely to provide and improve the matching service.

• Prohibited Content: You may not upload content that is illegal, defamatory, obscene, or infringes on the intellectual property rights of others.

4. Data Privacy and Transfers

• Privacy Policy: Our data practices are governed by our Privacy Policy, which is incorporated into these Terms.

• International Transfers: You acknowledge that Cosnap LLC is a U.S. company and your data will be processed and stored on Amazon Web Services (AWS) servers located in the United States.

• Security: We implement industry-standard security measures, including AES-256 encryption at rest and TLS/SSL in transit to protect your data.

5. Payments and Subscriptions

• In-App Purchases: Any paid features or subscriptions for users are processed via third-party payment processors, such as the Apple App Store.

• Refunds: Fees are non-refundable unless stated otherwise or required by law.

6. Termination and Deletion

• Account Deletion: You may delete your account and all associated data at any time through the app settings.

• Data Removal: Upon deletion, your biometric identifiers and account data will be removed from active systems within 30 days. Backup copies may persist for up to 90 days before being permanently purged.

7. Limitation of Liability

• "As-Is" Service: Services are provided on an "as-is" and "as-available" basis without warranties of any kind.

• Liability Cap: To the maximum extent permitted by law, Cosnap LLC’s total liability for any claim arising out of these Terms is capped at $100 or the amount you paid us in the last 12 months, whichever is greater.

8. Governing Law

These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved through binding arbitration in San Francisco, CA, under the rules of the American Arbitration Association.
