Terms of Service for Cosnap Photographers

1. Agreement and Changes

• Agreement: By using the Services, you represent that you have the authority to bind yourself or your organization to these Terms.

• Modifications: Cosnap LLC reserves the right to modify these Terms at any time. We will notify you via cosnap.ai/terms-conditions or email. Continued use constitutes acceptance of changes.

2. Service Eligibility and Accounts

• Age: You must be at least 18 years old to use the Services independently. Users aged 13–18 require parent or guardian management.

• Account Responsibility: You must provide accurate registration information and maintain login confidentiality. You are liable for all activity occurring under your account. Notify us immediately at info@cosnap.ai regarding any unauthorized access.

3. Mandatory Biometric Compliance (Critical)

As a Cosnap Photographer, you utilize AI-driven facial recognition tools. You acknowledge and agree to the following:

• Responsibility for Consent: You are solely responsible for obtaining express, informed, and written consent from every individual (or their legal guardian) featured in your "Photographer Content" before processing their biometric data.

• Public Area Signage: If you use Cosnap in public or commercial spaces, you must post clear, conspicuous physical or digital signage at all entrances notifying the public that biometric identifiers are being collected.

• Jurisdictional Bans: You agree NOT to use facial recognition features in jurisdictions where the private use of such technology is prohibited (e.g., Portland, OR, or specific EU zones).

• No Cosnap Liability: Cosnap LLC provides the platform but does not provide legal advice or consent management. You use the Services at your own legal risk regarding biometric privacy laws (e.g., Illinois BIPA, GDPR, CCPA).

4. License and Content Ownership

• Ownership: You retain ownership of all "Photographer Content" you upload.

• License to Cosnap: You grant Cosnap LLC a worldwide, royalty-free, sublicensable license to use, store, and process your content (including facial recognition matching) solely to provide and improve the Services.

• Service License: We grant you a limited, non-transferable license to use the Services for your professional photography business, subject to these Terms.

5. Infrastructure and Storage

• AWS Integration: All Photographer Content and biometric data are stored on Amazon Web Services (AWS) S3 servers in the United States.

• Security: Data is encrypted at rest and in transit using AES-256 or equivalent standards.

• Data Loss: While we attempt to restore data from backups, Cosnap LLC is not liable for the permanent loss of Photographer Content.

6. Payment and Subscriptions

• Recurring Billing: Subscriptions involve recurring fees (monthly, quarterly, or yearly) charged automatically to your provided payment method.

• Non-Refundable: All fees are non-refundable unless required by law or stated otherwise in our Refund Policy.

• Taxes: You are responsible for all applicable taxes related to your use of the Services.

7. Indemnity and Limitation of Liability

• Indemnity: You agree to indemnify and hold harmless Cosnap LLC against any claims, civil penalties, or legal fees arising from your Photographer Content, your failure to obtain biometric consent, or your violation of these Terms.

• Liability Cap: To the maximum extent permitted by law, Cosnap LLC’s total liability is capped at the amount you paid us in the prior 12 months, or $100, whichever is greater.

• Disclaimer: Services are provided "as-is" without warranties of uninterrupted or error-free use.

8. Termination and Governing Law

• Termination: We may terminate your access at our discretion. Post-termination, your content may be deleted immediately.

• Governing Law: These Terms are governed by California law. Disputes shall be resolved via binding arbitration in San Francisco, CA, under American Arbitration Association rules.
