Cosnap Photographer Agreement

1. Privacy and Data Protection

• Commitment: Cosnap LLC is committed to protecting your privacy and the privacy of your subjects.

• Consent: You consent to the collection and processing of your personal data as outlined in our Privacy Policy.

• Global Standards: We comply with global data protection laws, including GDPR, CCPA/CPRA, POPIA, and the Australian Privacy Act.

2. Data Processing Agreement (DPA)

• Roles: When you upload photos containing personal data, you act as the Data Controller, and Cosnap LLC acts as the Data Processor.

• Compliance: You agree to ensure all uploads comply with applicable U.S. and international data protection laws.

• Infrastructure: Data is stored securely on Amazon Web Services (AWS) S3 servers in the United States, encrypted using AES-256 standards.

3. RAW Vault Service Terms

• Service Description: The RAW VAULT provides 100GB of free storage for select RAW photography files for a period of three (3) months.

• Strict Account Limitation: Photographers are strictly prohibited from creating more than one account to allocate additional free storage.

• Abuse Prevention: Using multiple email addresses or any other methods to bypass the 100GB limit is a violation of these Terms and will result in immediate account termination.

• Auto-Deletion Policy: You acknowledge and agree that all files stored on the free RAW VAULT plan will be automatically and permanently deleted after three (3) months of storage.

• Upgrades: You may upgrade to a paid subscription at any time if you require storage exceeding 100GB or a longer retention period.

4. Mandatory Biometric Compliance

• Explicit Consent: You must obtain explicit, written consent from all individuals (or guardians) in your photos for biometric processing before uploading them.

• Public Notice: For photography in public areas, you are responsible for providing clear and conspicuous signage to the public regarding biometric collection.

• Liability: Cosnap LLC is not liable for your failure to obtain these approvals or provide required notices.

5. Acceptable Use and Content Integrity

• Ownership: You retain ownership of all Photographer Content you upload.

• Synthetic Media: You are strictly prohibited from uploading Deepfake or AI-generated synthetic media intended to deceive or impersonate individuals without their consent.

• Misuse of AI: You may not misuse AI tools to generate unethical or illegal content.

6. Limitation of Liability and Indemnity

• As-Is Service: Services are provided as-is without warranties of any kind.

• Liability Cap: Our total liability is capped at the amount paid to us in the prior 12 months, or $100, whichever is greater.

• Indemnification: You agree to defend and indemnify Cosnap LLC against any claims, civil penalties, or legal fees resulting from your failure to comply with biometric privacy laws or these Terms.

7. Governing Law

These Terms are governed by the laws of the State of California, U.S.. Disputes shall be resolved via binding arbitration in San Francisco, CA.
